II. General information on data processing by IC Immobilien Holding GmbH

Use of our website does not require prior registration. When you visit our website, we collect and process the automated information that you transmit to us and/or personal data.

1. Scope and purpose of processing personal data

As a rule, we collect and use our users’ personal data only to the extent that is necessary to provide a functional website as well as our content and services. We usually collect and use our users’ personal data only after receiving their consent. An exception is made for cases in which it is not possible to obtain consent beforehand for practical reasons and data processing is permitted by law.

2. Legal basis for processing personal data

Where we obtain the consent of the user  for personal data processing, Art. 6(1), sentence 1, point (a) GDPR serves as a legal basis. Otherwise, the further provisions in Art. 6(1) GDPR apply.

3. Erasure of data and storage period

Personal data regarding the user in question will be erased or made unavailable as soon as the reason for storage ceases to apply. Data will also be made unavailable or erased when a prescribed storage period expires, unless it is necessary to continue to store the data for the purpose of conclusion or performance of a contract.

III. Scope, purpose and legal basis for processing your data

1. You contact us / contact form

a. If you contact us directly, whether by using our contact form or by means of an email to one of the email addresses given on the website, we process the personal data you provide in doing so, such as your name, your email address and other information, only to the extent necessary to fulfill the purpose of your communication and to provide the services you desire, e.g. contact feature. Giving your name and email address is voluntary and consensual. You consent to us collecting and storing the data electronically in order to reply to your query. 
 

b. The legal basis for personal data processing as described in paragraph 1.a. is Art. 6(1), sentence 1, point (a) GDPR if consent is granted. The legal basis for processing data that is transmitted by email is Art. 6(1), sentence 1, point (f) GDPR (legitimate interests: the legitimate interest arises from the fact that we can only perform the action desired by the user (e.g. answering a query) by processing the corresponding user data).

2. Newsletter

a. On our website you can subscribe to a newsletter free of charge. In registering for the newsletter, the data that you enter into the input mask is transmitted to us (name and email address). In regard to data processing, your consent to IC Immobilien Holding GmbH transmitting your name and email address to our newsletter service provider is requested during registration so that the latter  can register you for newsletter dispatch and send the newsletter to you on our behalf.

The data is used solely for newsletter dispatch. Collecting the user’s name and email address serves the purpose of newsletter delivery.

b. The legal basis for processing data after newsletter registration by the user is Art. 6(1), sentence 1, point (a) GDPR.

c. The data will be erased as soon as it is no longer required for the purpose for which it was collected. Therefore, your email address will be stored for as long as your newsletter subscription is active.

You can cancel your newsletter subscription at any time. For this purpose, each newsletter contains a corresponding link with which the consent to storage of the personal data collected in the registration process can be withdrawn.

3. Transfer of data to third parties

Unless otherwise stated in this Privacy Policy, the personal data collected in connection with the use of this website will not be shared with third parties or transmitted in any other manner without your consent.

a. We may disclose your personal data to third parties if we are legally obligated to do so (e.g., at the request of a court or law enforcement agency). The legal basis for such data processing is Art. 6(1), sentence 1, point (c) GDPR (legal obligation).

b. We may also use (technical) service providers who process personal data on our behalf (e.g. IT service providers). These service providers process the respective personal data exclusively in accordance with our instructions and on our behalf (order processor; Art. 28 GDPR.

c. We transfer personal data to third parties based on your consent for us to do so (Art. 6(1), sentence 1, point (a) GDPR.

d. We may transfer personal data to third parties if we and/or the third party has a legitimate interest in this respect and the additional requirements of Art. 6(1) sentence 1, point (f) GDPR are met.

4. Providing the website

a. Every you visit our website, our system collects automated data and information sent by the computer system of the computer which calls up the website.

The following data are thereby collected:

  • Information on the type of browser and the version in use
  • The user’s operating system
  • The user’s internet service provider
  • The user’s IP address
  • Date and time of access
  • Websites from which the user’s system accessed our web page
  • Websites which the user’s system accesses via our website

 

The data is also stored in our system’s log files. This does not include the user’s IP address or other data that would allow the data to be attributed to a user. This data is not stored together with other personal data on the user.

b. Data processing occurs solely in order to enable use of the website (establishing a connection), for internal system-related purposes (technical administration, system security) and for statistical reasons, such as to evaluate general user behavior anonymously in order to better tailor it to meet your needs.

c. Insofar as the above data processed according to paragraph 4.a. is personal data, the corresponding data processing is based on Art. 6(1), sentence 1, point (f) GDPR (legitimate interests: the legitimate interest is that (i) use of the website can only be made possible if this data is processed (establishing a connection), (ii) we have a legitimate interest in protecting the website against attacks by third parties (system security) and/or (iii) we have a legitimate interest in understanding whether and how often the website is used (legitimate economic interest in evaluating this data).

d. The data is erased as soon it is no longer necessary to fulfill the purpose for which it was collected. In case where data is collected in order to provide the website, this is the case when the respective session ends.

e. Collecting data to provide the website and storing data in log files is inevitable in order to operate the web page. Therefore, the user cannot object.

This website uses Google Analytics, a web analytics service provided by Google and operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. If you do not consent to the use of Google Analytics cookies when you (first) access this website, none of your personal data will be processed using this tool. Google Analytics helps us to evaluate how users interact with our website and enables us to collect information about the needs of our website’s users so that we can increase the usability and quality of our website. In order to conduct these evaluations, Google Analytics collects aggregated and anonymous or pseudonymous (statistical) data. The technologies used by Google Analytics include “cookies”, which are small files stored on your computer, tablet or phone that enable Google to analyse your use of this website (an overview of the cookies used in this respect can be found in the table below).

The data generated by these cookies and/or other technologies used by Google Analytics to collect information on your interactions with this website may also be transferred (in part) to Google servers in the United States for processing. However, your IP address will generally be truncated before being transferred. The legal basis for the processing of personal data described above is Article 6(1), sentence 1, point (a) GDPR (consent).

As described above, data may also be processed and/or stored by Google on servers in the United States. With regard to the United States, there is currently a (limited) adequacy decision by the EU Commission; Google LLC has been certified accordingly with regard to this decision. In addition, Google uses standard data protection clauses within the meaning of Art. 46, sentence 2, point (c) GDPR. 7. Job Applicants

We process personal data supplied by job applicants (e.g. name, contact details, resume data) who contact us in connection with this website. The legal basis for the related processing of personal data is Art. 6(1), sentence 1, point (b) GDPR (contractual and/or pre-contractual measures).

IV. Data Security

Unfortunately, transferring information using the internet is not fully secure which is why we cannot guarantee the security of data transmitted to our website over the internet. However, we protect our website and other systems with technical and organizational measures against loss, destruction, access, alterations and dissemination of your data by unauthorized persons. When collecting and processing personal data, data is encrypted during transfer in order to prevent misuse of data by third parties. To do so we use SSL. Our security measures are continuously revised according to technological developments. Our employees are obligated to maintain confidentiality.

V. Scope of application of this privacy policy / third-party websites

This privacy policy applies solely to the website, services or offers provided by the IC Immobilien Holding GmbH. Our privacy policy does not apply to services, offers or websites linked to our web presence that are provided by other companies or persons. Our privacy policy especially does not encompass information or data processing by third parties.

If you use a hyperlink to access a third-party website, please note that we cannot assume responsibility or liability for foreign content or data protection conditions. The respective operators are liable for such websites.

The offers presented in the services section, Letting, under the heading “Property Offers” are, in technical terms, provided directly by Immo Scout24 (Immobilien Scout GmbH). By clicking the link “Immo Scout24 (only in German)” in the “Letting” section, you will be forwarded directly to the Immo Scout24 server. For technical reasons, your IP address will be transferred to Immo Scout24 in order to do so. We have no influence on this data transfer. VI. Changes to these data protection provisions

The constant development of the internet makes amendments of our privacy policy necessary from time to time. We reserve the right to change these data protection provisions at any time with effect for the future. A current version is available on the website. Within the framework of statutory requirements, you have the following rights in relation to us regarding your personal data:
